A Local Law to amend the administrative code of the city of New York, in relation to truck routing sheets and maps depicting legal truck routes.

 

Be it enacted by the Council as follows:

 

                     Section 1.  Subchapter 3 of Chapter 1 of Title 19 of the administrative code of the city of New York is amended by adding a new section 19-178.1 to read as follows:

                     19-178.1.  Mandatory truck documents. a. For purposes of this section, the following terms shall have the following meanings: 1. “Truck” shall mean any vehicle or combination of vehicles designed for the transportation of property, which has either two axles and six tires or three or more axles.

                     2. “Through truck” shall mean any truck having neither an origin nor a destination within the city of New York.

                     3. “Local truck” shall mean any truck with an origin or destination for the purpose of delivery, loading or servicing, within the city of New York.

                     4.  “Owner” shall have the meaning set forth in section 128 of the vehicle and traffic law.   

                     b. All owners of trucks operating within the city of New York shall supply drivers of those trucks with color-coded maps depicting the legal routes that through trucks may take within the city, as well as the legal routes that local trucks may take.  Owners shall certify that such maps accurately depict legal through truck routes and local truck routes and shall have such certification, with map attached notarized or the equivalent if such certification is made outside of the state of New York.  Any owner of a truck operating within New York City who violates the provisions of this subdivision shall be liable for a civil penalty of two hundred fifty dollars for each violation.

                     c.  All owners of trucks operating within the city of New York shall supply drivers of those trucks with a truck routing sheet, in a form to be approved by the commissioner, on which shall be recorded the points of origin and destination for any truck trip and the date of such trips.  Drivers of such trucks shall have such document in their possession throughout each trip.  Any owner of a truck operating within New York City who violates the provisions of this subdivision shall be liable for a civil penalty of one hundred dollars for each violation.

                     §2.  This local law shall take effect ninety days after it is enacted into law.
