Res. No. 470 Title Resolution calling for United Cerebral Palsy of New York City to negotiate in good faith and finalize a contract with the United Federation of Teachers. Body By Council Members Quinn, Jackson, Weprin, Nelson, Barron, Oddo, Koppell, Liu, Avella, Stewart, Foster, Fidler, Perkins, Brewer, Addabbo, Baez, Clarke, Comrie, Dilan, Felder, Gennaro, Gerson, Lopez, Martinez, McMahon, Monserrate, Sanders, Sears, Serrano, Vann, DeBlasio and Reyna; also Council Members Rivera and Yassky Whereas, Employees at United Cerebral Palsy of New York City (NYC) provide valuable services to disabled children and adults; and Whereas, Employees at various United Cerebral Palsy sites throughout NYC voted to join the United Federation of Teachers in three duly-certified National Labor Relations Board elections in August 2000, April 2001, and September 2001; and Whereas, United Cerebral Palsy of NYC has refused to engage in any collective bargaining on behalf of those employees at the Lawrence Avenue site who voted in the April 2001 election, leading to the filing of an unfair labor practice charge on behalf of those employees by the United Federation of Teachers; and Whereas, United Cerebral Palsy of NYC has stalled negotiations which have been ongoing since November 2000; and Whereas, United Cerebral Palsy of NYC has engaged in costly legal proceedings that have delayed certification of the September 2001 election results; and Whereas, The majority of employees at United Cerebral Palsy of NYC who are involved in direct client care earn less than $20,000 per year; and Whereas, United Cerebral Palsy of NYC has frozen the salaries of its unionized employees, some of whom have not had a raise since July 1999; and Whereas, United Cerebral Palsy of NYC has not made any offer of salary increase during contract negotiations; and Whereas, United Cerebral Palsy of NYC receives the vast majority of their funding from the state and city government; and Whereas, United Cerebral Palsy of NYC is not able to fill certain positions because of inadequate pay and the quality of the care it provides for disabled children and adults is suffering as a result; now, therefore, be it Resolved, That the Council of the City of New York calls upon United Cerebral Palsy of NYC to negotiate in good faith and finalize a contract with the United Federation of Teachers.
