Resolution calling upon the New York State Legislature to grant New York City the authority to repeal the sales tax on clothing and footwear under $110.

Whereas, The New York City Council approved in the budget for fiscal year 2004 a return of the sales tax for clothing and footwear under $110; and
Whereas, When the budget was approved, the sales tax on clothing and footwear under $110 was to sunset in June 2004; and
Whereas, The purpose of this sunset provision was to ensure that after one year of levying this sales tax to help the City through its budget crisis, the tax would be repealed; and
Whereas, The New York State Legislature and Governor Pataki, during their budget proceedings, rescinded New York City’s authority to repeal the sales tax on clothing and footwear under $110; and
Whereas, The sales tax on clothing and footwear is a regressive tax that is bad for business, and burdensome for seniors and for families across the City; and
Whereas, By restoring New York City’s authority to repeal the sales tax on clothing and footwear under $110, New Yorkers would no longer be burdened by this regressive tax; now, therefore, be it
Resolved, That the Council of the City of New York calls upon the New York State Legislature and Governor Pataki to grant the City of New York the authority to repeal the sales tax on clothing and footwear under $110.
