A Local Law to amend the administrative code of the city of New York, in relation to creating a program to provide additional assistance to senior citizens who qualify for federal assistance under the Low-Income Home Energy Assistance Program (HEAP).

 

Be it enacted by the Council as follows:

 

Section 1.  Chapter 2 of title 21 of the administrative code of the city of New York is amended by adding section 21-203 to read as follows:

a. Establishment of Home Energy Assistance Program.  There is hereby established a Home Energy Assistance Program to be administered by the department which shall do the following:

1.  conduct outreach activities to low income households that are having difficulty meeting their home energy costs; and

2.  make available, subject to appropriation, HEAP supplements for qualified households.

b. Definitions.  For the purposes of this section, the following terms shall have the following meanings:

1.  “qualified household” shall mean a household that applies for and is eligible for a grant to pay its energy heating costs under the federal Low Income Home Energy Assistance Program, in which the head of such household is sixty-five years of age or older, whether or not such household receives such federal grant.

2. “HEAP supplement” shall mean financial assistance for homeowners or renters, equal in amount to the individual payments provided to homeowners and renters by the department in fiscal year 2001 pursuant to a modification to the fiscal year 2001 budget adopted January 24, 2001 providing an appropriation for HEAP.

c.  Rules and agreements.  The department shall promulgate any rules and enter any agreements necessary to implement the provisions of this section.

§ 2.  This local law shall take effect immediately.
