A Local Law to amend the administrative code of the city of New York, in relation to the transportation, conveyance or removal of materials, waste and debris from Ground Zero, the site of the former World Trade Center.

 

Be it enacted by the Council as follows:

 

Section 1.  Title 16 of the administrative code of the city of New York is hereby amended by adding a new section 16-117.2 to read as follows:

§ 16-117.2 Transportation, conveyance or removal of materials, waste and debris to and from Ground Zero, the site of the former World Trade Center. 1. The transportation, conveyance or removal of any materials, waste or debris to and from Ground Zero, the site of the former World Trade Center, upon city streets shall only take place between 3:30 p.m. and 9:30 p.m. on Monday through Friday, and 12:00 p.m. (noon) and 12:00 a.m. (midnight) on weekends and legal holidays.

2. No materials, waste or debris shall be transported, conveyed or removed from Ground Zero, the site of the former World Trade Center, in a non-airtight container unless, prior to transport, conveyance or removal, such materials, waste or debris is saturated with water sufficient to prevent all visible emissions of dust into the air.

3. Nothing in this section shall affect the recovery and transport of human remains.

4. The commissioner shall promulgate rules in accordance with this section.

5.  Any person that fails to comply with the provisions of this section shall be subject to a civil penalty not to exceed five hundred dollars as determined by the commissioner.

§ 2.  This local law shall take effect immediately.
