A Local Law to amend the administrative code of the city of New York, in relation to requiring bird friendly materials in certain existing buildings and the development of a bird friendly materials workforce
Be it enacted by the Council as follows:
Section 1. Title 22 of the administrative code of the city of New York is amended by adding a new chapter 15 to read as follows:
CHAPTER 15
BIRD FRIENDLY MATERIALS WORKFORCE
§ 22-1501 Definitions. For the purposes of this chapter, the following terms have the following meanings:
Director. The term “director” means the director of the mayor’s office of talent and workforce development.
Mayor's office of talent and workforce development. The term "mayor's office of talent and workforce development" means the office established under executive order number 22 for the year 2022 or any successor office or agency that carries out the same or substantially similar functions.
Registered glazier apprenticeship program. The term “registered glazier apprenticeship program” means an apprenticeship program registered with, and approved by, the commissioner of labor of the state of New York pursuant to article 23 of the labor law that offers classroom and practical instruction in the installation, removal, and replacement of glass, including the installation of bird friendly materials pursuant to section 1403.8 of the New York city building code.
§ 22-1502 Bird friendly materials workforce development program. The mayor’s office of talent and workforce development shall administer a workforce development program for glazier apprenticeships, with such program designed to facilitate employment for persons who seek employment installing bird friendly materials. In administering such program, the mayor’s office of talent and workforce development shall:
1. Create and make publicly available a list of employers participating in such workforce development program;
2. Maintain an online resource accessible to employers and to persons seeking employment for the purpose of connecting such persons with registered glazier apprenticeship programs, including a current list of vacant positions as voluntarily reported by employers participating in such workforce development program;
3. Create and make publicly available resources to support persons who seek employment installing bird friendly materials throughout the job search process and after they have obtained employment, including guidance on writing resumes and cover letters, interview skills, making disclosures, and communicating with prospective employers about the terms and conditions of employment; and
4. Perform any other function or offer any other service within the power of the mayor's office of talent and workforce development that, in the determination of the director, will advance the purpose of this chapter, where practicable.
§ 2. Exception 20 of section 28-101.4.3 of the administrative code of the city of New York, as added by local law 15 for the year 2020, is amended to read as follows:
20. Where the alteration of a building includes the replacement of [all] any exterior glazing, [such alteration] the replacement exterior glazing shall comply with section 1403.8 of the New York city building code.
§ 3. Article 315 of title 28 of the administrative code of the city of New York is amended by adding a new section 28-315.13 to read as follows:
§ 28-315.13 Bird friendly materials. By January 1, 2030, existing buildings whose main use or dominant occupancy is classified in group B, M, or R pursuant to the New York city building code shall comply with Section 1403.8 of the New York city building code.
Exception: Detached one- and two-family dwellings are not required to comply with this section.
§ 4. This local law takes effect immediately.
