A Local Law to amend the administrative code of the city of New York, in relation to requiring public notification of any spraying of pesticides.
 
 
Be it enacted by the Council as follows:
 
Section 1.  The administrative code of the city of New York is amended by adding a new section 17-179 to read as follows:
Section 17-179  Notification of pesticide spraying.  a. The department shall provide emergency notice to the public of the spraying of any pesticides in areas targeted by the department as requiring such spraying in order to prevent the spread of disease.  The department shall:
1. Notify, by telephone, facsimile and/or electronic mail, all elected officials, police precinct commanders, chairs of community boards, and board of education officials in an area targeted for spraying of the targeted spray area and the schedule for spraying such area. Any updates and changes to such communicated schedule shall be similarly reported to such parties in a prompt manner.
2.  Provide for the publication of a spraying schedule in the form of a press release and for the distribution of such press release to major English and non-English media in the city.  Any updates and changes to such distributed schedule shall be promptly included in a new press release and be similarly issued by the department.
3.  Post on its website the areas targeted for spraying and the corresponding spraying schedules.  Any updates and changes to such information shall be promptly posted on such website by the department.
4.  Establish a hotline dedicated solely to providing information to the public regarding areas targeted for spraying and the most current spraying schedules available.
5. Arrange for department vehicles to patrol areas targeted for spraying and make announcements of when and where such spraying shall take place.
6. Print and make available to the public in areas targeted for spraying bulletins and fliers containing current spraying schedules and any other information deemed necessary by the department.  Any updates and changes to information made so available shall be promptly printed and made available to the public in the same manner.
b.  The commissioner shall promulgate such rules as are necessary for the purposes of implementing and carrying out the provisions of this section.
ยง 2.  This local law shall take effect immediately.
