Resolution calling upon the New York State Senate to pass S.3437, an act to amend the New York State Public Health Law to increase the maximum fine for noncompliance with canine waste removal laws from $100 to $250.

 

By Council Members Vallone Jr., Brewer, Gentile, Liu, Mealy and Palma

 

Whereas, Removal of canine waste is a problem in New York City; and

Whereas, It is unhealthy to leave canine waste on the sidewalk, street or other public areas; and

Whereas, Currently, section 1310 of the New York State Public Health Law (PHL) requires that each dog owner or person having possession, custody or control of a dog must remove any feces left by his dog on any sidewalk, gutter, street, or other public area in cities with a population of four hundred thousand or more persons and the cities of Yonkers and Albany; and

Whereas, Any violation of PHL section 1310 carries a maximum fine of $100; and

Whereas, Despite the current fine of $100, some violators repeatedly fail to comply with the law; and

Whereas, S.3437 would amend PHL section 1310 and increase the maximum fine to $250; and

Whereas, The purpose of the amendment is to act as a deterrent and encourage owners to clean up after their dogs; now, therefore, be it

Resolved, That the Council of the City of New York calls upon the New York State Senate to pass S.3437, an act to amend the New York State Public Health Law to increase the maximum fine for noncompliance with canine waste removal laws from $100 to $250.
