Resolution calling upon the New York State Legislature to amend Sections 458 and 458-a of the New York Real Property Tax Law, in relation to extending partial property tax exemption provisions of such sections to the school tax portion of New York State property taxes for qualified veterans.

Whereas, The men and women of the U.S. military have made incredible personal sacrifices on behalf of this country; and
Whereas, According to the Mayor's Office of Veterans Affairs, currently over 302,000 veterans live in New York City; and
Whereas, Provisions of New York State law provide partial property tax exemptions to qualified veterans of the United States military; and
Whereas, Specifically, Section 458 of the New York State Real Property Tax Law provides a partial property tax exemption to veterans who have purchased real property using a bonus, pension, insurance or compensation received as a result of being a prisoner of war; and
Whereas, Section 458-a of the New York State Real Property Tax Law provides a partial property tax exemption based on service rendered, including service during wartime, service in a combat zone and status as a disabled veteran; and
Whereas, Section 458 and Section 458-a are applicable only to county, city, town and village taxation, and are not applicable to taxes levied for school purposes; and
Whereas, Approximately 55 percent of an average New York City property tax bill represents the school tax portion; and
Whereas, Therefore, veterans who qualify for Section 458 and Section 458-a property tax relief are still required to pay the entire school tax portion of their property bills; and
Whereas, In view of the incredible personal sacrifices made by our veterans on behalf of this country, it would be appropriate to extend the exemption provisions of Section 458 and Section 458-a to the school tax portion of New York State property taxes; and
Whereas, The extension of the veterans' property tax credits to include relief from taxes levied to cover school related expenses will ease veterans concerns for their families' financial stability and their own futures; now, therefore, be it
Resolved, That the Council of the City of New York calls upon the New York State Legislature to amend Section 458 and 458-a the New York Real Property Tax Law, in relation to extending partial property tax exemption provisions of such sections to the school tax portion of New York State property taxes for qualified veterans.
