A Local Law to amend the charter of the city of New York, in relation to ensuring that eligible pre-trial detainees are allowed to register to vote and vote by absentee ballot.

 

Be it enacted by the Council as follows:

 

Section 1.  Section 1058  of chapter 46 of the charter of the city of New York is amended to add a new subdivision 8, to read as follows:

8. (a) The department of correction shall ensure that all pre-trial detainees incarcerated at its facilities who are eligible to vote, receive, upon request, a voter registration form.

(b) The department of correction shall ensure that all pre-trial detainees incarcerated at its facilities who are eligible to vote are afforded the opportunity to do so through completion of an absentee ballot.

(c) The distribution, collection and submission of voter registration forms and absentee ballots shall conform to the requirements of this section.

§2. This local law shall take effect sixty days after its enactment.
