A Local Law to amend the administrative code of the city of New York, in relation to the inspection and certification for pest abatement.

 

Be it enacted by the Council:

                     Section 1. Article 13 of chapter 1 of title 27 of the administrative code of the city of New York is amended by adding a new section 27-166.1  to read as follows:

                     §27-166.1 Pest Abatement and Certification for Foundation or Earthwork Permits. Notwithstanding any other provision of law, no foundation or earthwork permit shall be issued unless the department of health and mental hygiene inspects and certifies that the applicant for such permit has conducted appropriate baiting and trapping for pests, including rats, at the site for which the permit is sought. Any such permit shall not be issued unless the applicant submits, with the application, such certification from the department of health and mental hygiene. All applicants shall be prohibited from self-certifying that such baiting and trapping was conducted.

                     §2. Chapter 1 of title 17 of the administrative code of the city of New York is amended by adding a new section 17-113.1 to read as follows:

                     §17-113.1 Pest Abatement and Certification for Foundation or Earthwork Permits. Prior to the issuance of any foundation or earthwork permit by the department of buildings, the department shall conduct an inspection at the site for which the permit is sought. After a determination by the department that the applicant for such permit has conducted appropriate baiting and trapping for pests, including rats, the department shall issue a certification that appropriate baiting and trapping has been conducted at the site.

                     §3. This local law shall take effect ninety days after its enactment into law.
