A Local Law to amend the administrative code of the city of New York, in relation to the posting of a performance bond for the new construction of one-, two- or three-family dwellings.

 

Be it enacted by the Council as follows:

 

Section 1.                     Article 11 of subchapter one of chapter one of title 27 of the administrative code of the city of New York is amended by adding a new section 27-160.1 to read as follows:

§27-160.1  (a)  In addition to any other requirements required by this code, any person hired for the construction of a one-, two- or three-family dwelling, on property that is not owned by such person, must post with the department a performance bond in an amount no less than fifty thousand dollars per dwelling to insure the completion of construction by such person and any of such person’s subcontractors.

(b)  This section shall apply to the new construction of one-, two- or three-family dwellings only.

(c)  Notwithstanding the provisions of subdivision a of this section, this section shall not apply to:

(1)  The addition, alteration, beautification, construction, conversion, installation, modernization, remodeling, repair or replacement of an existing structure or portion thereof.

(2)  The sale of goods or materials by a seller who neither arranges to perform nor performs, directly or indirectly, any work or labor in connection with the installation of or application of any goods or materials with respect to the new construction of a one-, two-, or three-family dwelling.

(3)  The new construction of a one-, two- or three-family dwelling by the owner of the property upon which such dwelling shall be constructed.

§2.                     This local law shall take effect ninety days after its enactment into law.
