THE COUNCIL OF THE CITY OF NEW YORK RESOLUTION NO. 323 Title Resolution approving the decision of the City Planning Commission on ULURP No. M 880816 (A) ZMX, for the modification of Restrictive Declaration D-127, in connection with a proposed residential development on property generally bounded by Norton Avenue, Turneur Avenue, Zerega Avenue, Castle Hill Avenue, Castle Hill Park and Pugsley's Creek (Block 3483/Lots 1-41 (formerly Block 3483/Lot 1)), (Block 3486/Lots 31-62 (formerly Block 3486/Lots 22, 24, 26, 28 and 30)), in an R3-2 District (L.U. No. 166). Body By Council Members Katz and Avella WHEREAS, the City Planning Commission filed with the Council on April 18, 2002 its decision dated March 20, 2002 (the "Decision"), on the application submitted by the Castle Hill Holdings Corp. for the modification of Restrictive Declaration D-127, which was previously approved as part of an application for a Zoning Map Amendment (C 880816 ZMX), in connection with a proposed residential development on property generally bounded by Norton Avenue, Turneur Avenue, Zerega Avenue, Castle Hill Avenue, Castle Hill Park and Pugsley's Creek (Block 3483/Lots 1-41 (formerly Block 3483/Lot 1)), (Block 3486/Lots 31-62 (formerly Block 3486/Lots 22, 24, 26, 28 and 30)), in an R3-2 District (ULURP No. M 880816 (A) ZMX) (the "Application"); WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter; WHEREAS, the subject application is a request by the Castle Hill Realty Holdings Corp. to modify Restrictive Declaration D-127 as it relates to the subject property to permit residential development; WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on May 14, 2002 and recessed until May 28, 2002; WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and ____________ WHEREAS, the Council has considered the relevant environmental issues and the Notice of Minor Modification on December 14, 2001 which concludes that the Notice of Completion of the Final Environmental Impact Statement which was issued on November 11, 1988 remains valid; RESOLVED: The Council finds that the action described herein will have no significant effect on the environment. Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, the Council approves the Decision. Adopted.
