A Local Law to amend the administrative code of the city of New York in relation to prohibiting the desecration of cemetery plots and burial places. 

 

Be it enacted by the Council as follows:

 

                     Section one.  Chapter one of title ten of the administrative code of the city of New York is amended to add a new section 10-116.1, to follow section 10-116, to read as follows:

                     §10-116.1.  a.  Damaging cemetery plots or burial places prohibited.  It shall be unlawful for any person to intentionally and without authority damage or deface any real or personal property maintained as a cemetery plot, grave, burial place or other place of interment of human remains, or any appurtenance thereto.

                     b.  It shall be unlawful for any person to knowingly aid, abet, conceal or in any way assist another person to violate subdivision a of this section.

                     c.  Any person who violates the provisions of this section shall be guilty of a misdemeanor punishable by imprisonment of not more than one year or by a fine of not more than two thousand five hundred nor less than five hundred dollars or both.  In addition, any person who violates the provisions of this section shall be subject to a civil penalty not to exceed ten thousand dollars.

                     §2.                     This local law shall take effect sixty days after its enactment into law.
