A Local Law to amend the administrative code of the city of New York, in relation to making all children attending grades kindergarten through eight residing more than one and one-half miles from school eligible for general education transportation.
 
 
Be it enacted by the Council as follows:
 
      Section 1.  Chapter 6 of Title 19 of the administrative code of the city of New York is amended by adding new section 19-607 to read as follows:
      §19-607  Student eligibility for general education transportation  a.  For purposes of this section, "general education transportation" shall mean transportation on a school bus operated by or pursuant to a contract with the board of education between stops designated by the office of pupil transportation of the board of education and a specific school.
      b.  General education transportation shall be provided by the school district to and from school for all children who attend grades kindergarten through eight and reside within the school district provided that such children reside more than one and one-half miles from the school they legally attend.  Such transportation shall be provided for each such child up to a distance of five miles.  Distances are to be measured by the nearest available route from the child's home to school.
      c.  In no event shall the provisions of this section preclude the election by any parent or legal guardian of a child eligible for general education transportation of any transportation alternative made available by the board of education to children subject to the provisions of this section.
      §2  This local law shall take effect one hundred and twenty days after it is enacted into law.
