Title
Resolution making permanent the creation of a small purchase category called "information technology" with a one hundred thousand dollar limit by repealing the sunset provision.

By Council Members Freed, Espada, Warden, Fiala and Stabile (by the request of the Mayor); also Council Members Eisland, Fisher, Foster, Harrison, McCaffrey, Golden, Moskowitz and White.
Whereas, Pursuant to Section 314 of the New York City Charter, concurrent action by the Council of the City of New York and the Procurement Policy Board ("PPB") is necessary to establish dollar limits for small purchases by the City; and
Whereas, The PPB, on June 12, 1997, unanimously adopted a small purchase rule that included the creation of a small purchase category called "information technology" with a one hundred thousand dollar purchase limit; and
Whereas, On June 25, 1997, the City Council, by Council Resolution 2335-A, concurred in the creation of such small purchase category and dollar limit, but made such concurrence effective only until 12:01 A.M. on January 1, 2001; and
Whereas, A PPB rule became effective on August 6, 1997, creating the small purchase category called "information technology" with a one hundred thousand dollar purchase limit, subject to the sunset provision described above; and
Whereas, On June 8, 2000, the PPB adopted a rule amendment whereby the sunset provision for the "information technology" small purchase category was deleted; and
Whereas, Adoption by the City Council of Resolution 1393 is necessary in order to constitute concurrence with the PPB pursuant to the Charter, thereby making permanent the creation of a small purchase category called "information technology" with a $100,000 limit; and
Whereas, The Council finds that a one hundred thousand dollar "information technology" small purchase category is instrumental in enabling the City of New York to pursue more e-government and e-procurement initiatives while protecting its information technology from the threat of computer viruses; and
Whereas, The Mayor's Office of Contracts ("MOC") will annually report at the request of the PPB or the Council on the use of the small purchase rule for "information technology;" now, therefore, be it
Resolved, That the Council of the City of New York, in concurrence with the PPB, makes
permanent the creation of a small purchase category called "information technology" with a one hundred thousand dollar limit by repealing the sunset provision.
