A Local Law to amend the administrative code of the city of New York in relation to prohibiting the reckless operation of motorized scooters.
Be it enacted by the Council as follows:
Section 1. The title of section 19-176.1 of the administrative code of the city of New York is amended to read as follows:
§19-176.1 Reckless operation of roller skates, in-line skates [and] , skateboards and motorized scooters prohibited.
§2. The preface of subdivision a of section 19-176.1 of the administrative code of the city of New York and paragraph 2 of such subdivision, as enacted by local law number 43 for the year 1996, are amended to read as follows:
a. For purposes of this [section] subchapter:
(2) The term “reckless operation” shall mean operating roller skates, in-line skates [or], a skateboard or a motorized scooter on a public street, highway or sidewalk in such a manner as to endanger the safety or property.
§3. A new paragraph (6) is added to subdivision a of section 19-176.1 of the administrative code of the city of New York to read as follows:
(6) The term “motorized scooter” shall mean a device, not required to be registered pursuant to the vehicle and traffic law, consisting of a long footboard having one or two wheels at each end, to which is attached a low-powered gasoline or electric-powered engine, where the forward wheel or wheels are controlled by an upright steering bar.
§4. Subdivisions b and c of section 19-176.1 are amended to read as follows:
b. No person shall engage in the reckless operation of roller skates, in-line skates, [or ] a skateboard or a motorized scooter.
c. A violation of subdivision b of this section shall be a traffic infraction and shall be punishable in accordance with section 1800 of the vehicle and traffic law. Any person who is found guilty of the reckless operation of roller skates, in-line skates [or a] skateboard or a motorized scooter shall be subject to a fine of not less than fifty dollars nor more than one hundred dollars.
§5 This local law shall take effect immediately.
