A Local Law in relation to a pilot program regarding cleanliness and snow and ice removal from bus shelters, bike share stations, and public communications structures
Be it enacted by the Council as follows:
Section 1. a. For purposes of this section, the following terms have the following meanings:
Bike share program. The term “bike share program” has the same meaning as set forth in section 19-194 of the administrative code of the city of New York.
Bike share station. The term “bike share station” means a row of docks for the locking and unlocking of bicycles in a bike share program.
Operator. The term “operator” means a person that is responsible for keeping clean, or removing snow or ice from, a bus shelter, bike share station, or public communications structure pursuant to an agreement with the city.
Public communications structure. The term “public communications structure” means a kiosk or structure on a sidewalk that provides public access to the internet and other digital services, including a public pay telephone.
Public pay telephone. The term “public pay telephone” has the same meaning as set forth in section 6-01 of title 67 of the rules of the city of New York.
b. No later than May 1, 2026, the department of sanitation, the department of transportation, and the department of information technology and telecommunications shall establish a pilot program relating to cleanliness and snow and ice removal at bus shelters, bike share stations, and public communications structures. Such pilot program shall have a duration of no less than 2 years. As part of such pilot program, the department of sanitation shall notify:
1. The department of transportation, whenever the department of sanitation observes dirty conditions or the accumulation of snow or ice at a bus shelter or a bike share station; and
2. The department of information technology and telecommunications, whenever the department of sanitation observes dirty conditions or the accumulation of snow or ice at a public communications structure.
c. Upon receipt by the department of transportation or the department of information technology and telecommunications of such a notification, such department shall notify the operator of such bus shelter, bike share station, or public communications structure of such dirty conditions or accumulation of snow or ice, and shall instruct such operator to remedy such conditions or accumulation in accordance with the provisions of an agreement between the city and such operator. If such operator fails to remedy such conditions or accumulation in accordance with such provisions, such department shall take enforcement action as prescribed in such agreement, including the issuance of penalties or assessment of liquidated damages.
d. No later than November 1, 2028, the department of sanitation, the department of transportation, and the department of information technology and telecommunications shall submit a report to the mayor and the speaker of the council regarding the pilot program, including any recommendations regarding cleanliness of and snow and ice removal from bus shelters, bike share stations, and public communications structures.
§ 2. This local law takes effect immediately.
