Summary: This bill would require that the 311 Customer Service Center, in consultation with the Office of Cyber Command and the Chief Privacy Officer, provide an opportunity for 311 users to consent to sharing their personal contact information with the Council Member representing the area that is the subject of the 311 complaint, in order to follow up on 311 complaints.

A Local Law to amend the administrative code of the city of New York, in relation to requiring the 311 customer service center to provide 311 users with the opportunity share their personal contact information with a relevant council member

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 3 of title 23 of the administrative code of the city of New York is amended by adding a new section 23-315 to read as follows:

§ 23-315 Sharing identifying information of consenting 311 users. a. Definitions. As used in this section, the following terms have the following meanings:

Personal contact information. The term “personal contact information” means information that may be used to contact the user about their complaint, including, but not limited to, the user’s name, phone number, email address, physical address, date and time of the submitted complaint, text of the complaint, complaint number, and any other contact information.

Relevant council member. The term “relevant council member" means a council member representing the area where the subject of the 311 complaint is located. 

b. The 311 customer service center, in consultation with the office of cyber command and the chief privacy officer, shall provide 311 users with the opportunity to provide affirmative consent to share their personal contact information with the relevant council member for the purpose of following up on a submitted complaint. The 311 customer service center shall clearly state that providing consent is voluntary and is not required for the resolution of the user’s complaint.

c. Access to 311 data. The 311 customer service center in consultation with the office of cyber command and the chief privacy officer shall develop a system to provide relevant council members access to the personal contact information of 311 users who have consented to the sharing of their information pursuant to subdivision b of this section.

d. Limitations on the sharing of data. No personal contact information shall be shared with a council member unless the 311 user has provided affirmative consent.

§ 2. This local law takes effect 180 days after it becomes law.
