Resolution endorsing the Speaker's decision to file, on behalf of the Council, an amicus brief in support of Suffolk County in the litigation between the Retail Industry Leaders Association ("RILA") and Suffolk County for the purpose of supporting the City's Health Care Security Act (Local Law number 89 for the year 2005 and Local Law 1 for the year 2006).

Whereas, The Council passed Local Law number 89 for the year 2005 and Local Law number 1 for the year 2006, also known as the Health Care Security Act, which provides that certain employers must make health care expenditures on behalf of their employees; and
Whereas, Suffolk County passed similar legislation, known as The Fair Share for Health Care Act; and
Whereas, RILA has sued in Federal Court for the Eastern District of New York to declare the Suffolk County law invalid; and
Whereas, There are important legal issues involved in the Suffolk County litigation and the resolution of these issues likely will inform any future court's interpretation of the Health Care Security Act; now, therefore, be it;
Resolved, That the Council of the City of New York endorses the Speaker's decision to file, on behalf of the Council, an amicus brief in support of Suffolk County in the litigation between the RILA and Suffolk County for the purpose of supporting the City's Health Care Security Act (Local Law number 89 for the year 2005 and Local Law 1 for the year 2006).
