A Local Law to amend the administrative code of the city of New York, in relation to pharmaceutical supply chain resilience and industry development
Be it enacted by the Council as follows:
Section 1. Title 17 of the administrative code of the city of New York is amended by adding a new chapter 23 to read as follows:
CHAPTER 23
PHARMACEUTICAL INDUSTRY RESILIENCE AND DEVELOPMENT
§ 17-2301 Pharmaceutical industry workforce and business development program.
a. Program establishment. The department shall establish a pharmaceutical industry workforce and business development program to provide support for all sectors of the pharmaceutical industry operating in the city. The department shall collaborate with the department of education and the city university of New York, as well as any other agencies it deems proper, and may establish partnerships with educational institutions and workforce development organizations to recruit participants and facilitate program activities.
b. Survey. As part of the program established pursuant to subdivision a of this section, the department shall conduct surveys including, but not limited to, the following:
1. An overview of the existing pharmaceutical industry in the city, including capacity for research and development and manufacturing;
2. A census of educational programs in the city that train students for careers relevant to work in the pharmaceutical industry; and
3. A census of the city’s pharmacies, including both operational pharmacies as well as any that have closed within the last year.
§ 17-2302 Drug stockpile feasibility study. The department shall conduct a study of the feasibility of creating a city-administered stockpile of critical medications. As part of such study, the commissioner shall determine:
1. The cost of creating such a drug stockpile;
2. The extent to which such a stockpile may overlap with similar federal and state stockpiles;
3. Which drugs are most likely to be subject to supply chain disruptions, treat conditions that necessitate uninterrupted care, and would provide the most potential benefit from stockpiling; and
4. How often such a stock would need to be rotated, and whether any drugs stockpiled may be eligible for an expiration dating extension.
§ 17-2303 Reporting. a. Report. No later than 1 year after the effective date of the local law that added this section, the commissioner shall submit to the mayor and the speaker of the council and post on the department’s website a report on the department’s findings on the following:
1. The results of the surveys conducted pursuant to subdivision b of section 17-2301 of this chapter;
2. The results of the feasibility study conducted pursuant to section 17-2302 of this chapter; and
3. A summary of program activities, recommendations for improvement, and any other findings deemed relevant.
b. Map. The commissioner shall publish on the department’s website a map displaying all operational pharmacies as determined pursuant to paragraph 3 of subdivision b of section 17-2301 of this chapter.
§ 2. This local law takes effect 120 days after it becomes law.
