Resolution calling upon the State Legislature to pass S. 8244 introduced by State Senator Thomas Duane that would strengthen enforcement of noise regulations governing motor cycles by requiring inspections every six months and increasing fines for using improperly equipped motorcycles.

By Council Members Quinn, Freed and Moskowitz; also Council Members Provenzano, Reed and Wooten
Whereas, The State Vehicle and Traffic Law Section 381 (11) (1) requires that a motor cycle be equipped with a muffler to prevent "excessive or unusual noise;" and
Whereas, Subdivisions three and four of this section prohibit "straight pipes" or other devices that modify motor cycle exhaust system in a manner that amplifies or increases noise; and
Whereas, Excessive noise from motorcycles on city streets can create a severe nuisance; and
Whereas, The requirements for proper equipment on motor vehicles is enforced by a system of annual vehicle inspections required by §301 (a) of the State Vehicle and Traffic Law; and
Whereas, This legislation would enhance enforcement by increasing the maximum fine for an improperly equipped motorcycle from the current $100 to $500 for a violation of the provisions of §381 of the New York State Vehicle and Traffic Law; and
Whereas, Senate Bill S. 8244 would modify the current system of inspections by requiring that motorcycles be inspected every six months; and
Whereas, Inspections twice a year would insure that motor cycles are properly maintained and their muffler systems are in good working order; and
Whereas, Motorcycles are also inspected for safety equipment, and this legislation would insure that safety devices are properly maintained; now, therefore, be it
Resolved, That the Council of the City of New York calls upon the State Legislature to pass S. 8244 introduced by State Senator Thomas Duane which would strengthen enforcement of noise regulations governing motor cycles by requiring inspections every six months and increasing fines for using improperly equipped motorcycles.
