A Local Law to amend the administrative code of the city of New York, in relation to requiring landlords to maintain in good repair smoke detecting devices in dwelling units of senior citizens and disabled persons.
Be it enacted by the Council as follows:
Section one. Subdivision a. of Section 27-2045 of the administrative code of the city of New York is amended by adding a new paragraph (6) to read as follows:
(6) Keep and maintain such device in good repair for any occupant who is over the age of 62 or is disabled as defined in subdivision 16 or §8-102 of the administrative code of the City of New York.
b. Notwithstanding the provisions of subdivision a of section 27-2005 and subdivision c of section 27-2006 of this code, and except as set forth in subdivision a of section 27-2045 of this code, it shall be the sole duty of the occupant of each dwelling unit as a class A multiple dwelling Unit in which a smoke detecting device has been provided and installed by the owner to:
(1) Keep and maintain such device in good repair; and
(2) Replace any and all devices which are either stolen, removed, missing or rendered inoperable during the occupancy of such dwelling unit.
§2. This local law shall take effect 60 days after its enactment.
