A Local Law to amend the administrative code of the city of New York, in relation to voluntary environmental impact and use disclosures in city procurement of artificial intelligence tools
Be it enacted by the Council as follows:
Section 1. Chapter 1 of title 6 of the administrative code of the city of New York is amended by adding a new section 6-152 to read as follows:
§ 6-152 Environmental impact and energy use disclosures in AI procurement.
a. Definitions. For purposes of this section the following terms have the following meanings:
AI contract. The term “AI contract” means any contract for any AI tool, provided, however, that such term shall not include emergency procurements and contracts subject to federal or state requirements that preclude additional disclosures.
AI tool. The term “AI tool” means any technology or computerized process that uses artificial intelligence, machine learning, or predictive analytics.
Environmental impact and energy use disclosure. The term “environmental impact and energy use disclosure” means a voluntary statement from a bidder describing such bidder’s efforts to identify and address the environmental impact, sustainability, and energy usage of the bidder’s AI tool.
b. Voluntary disclosure. During procurement for an AI contract, the contracting agency may request that each bidder submit an environmental impact and energy use disclosure. Any failure to submit such a disclosure shall not form a basis for a determination that a bidder is not a responsible bidder.
c. Standard form. The director of contract services shall develop a standardized environmental impact and energy use disclosure form that contracting agencies shall use when requesting environmental impact and energy use disclosures pursuant to this section. Such form shall be made publicly available on the city’s website.
§ 2. This local law takes effect 120 days after it becomes law.
