A Local Law to amend the administrative code of the city of New York, in relation to the installation of traffic calming devices in bicycle lanes
Be it enacted by the Council as follows:
Section 1. Chapter 3 of chapter 1 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-183.2 to read as follows:
19-183.2 Traffic calming devices installed in bicycle lanes. a. Definitions. As used in this local law, the following terms have the following meanings:
Authorized emergency vehicle. The term “authorized emergency vehicle” has the same meaning as set forth in section 101 of the vehicle and traffic law.
Bicycle lane. The term “bicycle lane” means a portion of the roadway that has been marked off or separated for the preferential or exclusive use of bicycles.
Micromobility device. The term “micromobility device” means a device intended for personal transportation within the city of New York that is not a motor vehicle, as such term is defined in section 125 of the vehicle and traffic law, including, but not limited to, bicycles, electric bicycles, scooters, and electric scooters.
Traffic calming device. The term "traffic calming device" means a device, including but not limited to bicycle lane redesigns, chicanes, and raised crosswalks, installed in a bicycle lane and intended to slow, reduce, or alter bicycle lane traffic to enhance safety for pedestrians and cyclists.
b. Installation. No later than 1 year after the effective date of the local law that added this section, the commissioner shall identify street intersections containing a bicycle lane in which no traffic calming device has been installed, and shall install a traffic calming device in such bicycle lane at no less than 50 such intersections. The commissioner shall determine which type of traffic calming device is appropriate in each such bicycle lane, in accordance with any relevant departmental guidelines.
c. Access. The commissioner shall install such traffic calming devices in a manner that allows for access, entry, exit, and passage by, at minimum, authorized emergency vehicles.
d. Considerations. The commissioner shall consider, at a minimum, the following factors in selecting bicycle lanes for traffic calming device installation pursuant to subdivision b of this section:
1. Vehicular traffic patterns;
2. Vehicular traffic congestion;
3. Micromobility device traffic patterns;
4. Micromobility device traffic congestion;
5. Estimated daily foot traffic;
6. The total number of crashes between vehicles and micromobility devices;
7. The total number of injuries sustained in crashes between vehicles and micromobility devices;
8. The total number of crashes between micromobility devices and pedestrians;
9. The total number of injuries sustained in crashes between micromobility devices and pedestrians;
10. The total number of crashes between two or more micromobility devices;
11. The total number of injuries sustained in crashes between two or more micromobility devices;
12. The total number of crashes involving a single micromobility device;
13. The total number of injuries sustained in crashes involving a single micromobility device; and
14. Topographic features.
e. Discretion. The commissioner may decline to install any traffic calming device that is otherwise required by this section if such installation would, in the commissioner’s judgment, endanger the safety of motorists, pedestrians, or cyclists, or not be consistent with any relevant departmental guidelines.
f. Study. The commissioner shall conduct a study regarding traffic calming devices installed in bicycle lanes pursuant to subdivision b of this section and shall develop recommendations regarding the maintenance of such devices and the installation of additional such devices. Such study shall analyze the impact of such installations on the following, with respect to each bicycle lane where a traffic calming device was installed:
1. The estimated total number of daily cyclists;
2. The total number of crashes between vehicles and micromobility devices;
3. The total number of injuries sustained in crashes between vehicles and micromobility devices;
4. The total number of crashes between micromobility devices and pedestrians;
5. The total number of injuries sustained in crashes between micromobility devices and pedestrians;
6. The total number of crashes between two or more micromobility devices;
7. The total number of injuries sustained in crashes between two or more micromobility devices;
8. The total number of crashes involving a single micromobility device; and
9. The total number of injuries sustained in crashes involving a single micromobility device.
h. Report. 1. No earlier than 2 years after the effective date of the local law that added this section, and no later than 2 years and 6 months after such effective date, the commissioner shall submit to the mayor and the speaker of the council and post conspicuously on the department’s website a report regarding traffic calming devices installed pursuant to subdivision b of this section. Such report shall include, at minimum:
(a) The findings of, and recommendations developed through, the study required by subdivision f of this section;
(b) A list of any criteria, beyond the considerations set forth in subdivision d of this section, the commissioner used to select each street intersection for installation of traffic calming devices in such intersection’s associated bicycle lane;
(c) A list of criteria the commissioner used to select the precise location of each traffic calming device within each bicycle lane; and
(d) A list of criteria the commissioner used to determine the types of traffic calming device installed.
2. Such report shall also include a table in which each separate row references a street intersection where a traffic calming device was installed in a bicycle lane pursuant to subdivision b of this section. Each such row shall include the following information, as well as any additional information the commissioner deems appropriate, set forth in separate columns:
(a) The location of such intersection;
(b) The location of each traffic calming device installed in a bicycle lane at such intersection;
(c) The number of bicycle lanes at such intersection;
(d) A description of the bicycle lanes at such intersection, including the direction of travel corresponding to each such lane;
(e) The number of traffic calming devices installed in bicycle lanes at such intersection; and
(f) The type of each traffic calming device installed.
§ 2. This local law takes effect immediately.
