Summary: This bill would require that sidewalk riding detection technology, and an accompanying deceleration safety feature, be installed on e-bikes and e-scooters that are part of self-service share systems. There would be no civil penalty for a share system owner or operator for a first violation, but subsequent violations committed within two years would carry a civil penalty of up to $1,000.

A Local Law to amend the administrative code of the city of New York, in relation to the installation of sidewalk riding detection technology on electric bicycles and electric scooters that are part of share systems

 

Be it enacted by the Council as follows:

 

Section 1. Subchapter 3 of chapter 1 of title 19 of the administrative code of the city of New York is amended by adding a new section 19-176.4 to read as follows:

§ 19-176.4 Use of sidewalk riding detection technology in electric micromobility share systems. a. Definitions. As used in this section, the following terms have the following meanings:

Bicycle with electric assist. The term “bicycle with electric assist” has the same meaning as set forth in section 102-c of the vehicle and traffic law.

Electric micromobility device. The term “electric micromobility device” means a bicycle with electric assist or an electric scooter.

Electric micromobility share system. The term “electric micromobility share system” means a network of self-service and publicly available electric micromobility devices, and any related infrastructure, in which a trip begins or ends on any highway, as such term is defined in section 118 of the vehicle and traffic law.

Electric scooter. The term “electric scooter” has the same meaning as set forth in section 114-e of the vehicle and traffic law.

Sidewalk. The term “sidewalk” means the portion of a street between the curb lines or the lateral lines of a roadway and the adjacent property lines, intended for the use of pedestrians.

Sidewalk riding detection technology. The term “sidewalk riding detection technology” means any hardware or software mechanism that detects when an electric micromobility device is mounting or riding on a sidewalk, including but not limited to:

1. Location-based technology such as the global positioning system, or a comparable location tracking technology, that uses navigational satellites to determine a location in real time and is capable of collecting, storing, and transmitting geographical data;

2. Light detection and ranging technology;

3. Camera-based detection technology; or

4. Gyroscopes, accelerometers, or other similar methods of detecting patterns of vibration typical of mounting or riding on a sidewalk.

b. A person who owns or operates an electric micromobility share system shall install, and maintain in working order, sidewalk riding detection technology on each electric micromobility device used as part of the electric micromobility share system.

c. A person who owns or operates an electric micromobility share system shall ensure that each electric micromobility device used as part of the electric micromobility share system utilizes a safety feature that relies on sidewalk riding detection technology to gradually decelerate an electric micromobility device that has mounted or is riding on a sidewalk to the point of stopping, until the electric micromobility device fully leaves the sidewalk.

d. Any person who violates subdivision b or c of this section is liable for a civil penalty as follows:

1. For the first violation, a civil penalty of zero dollars; and

2. For each subsequent violation with a notice of violation issued for the same violation on a different day within 2 years of the date of a first violation, a civil penalty of not more than $1,000.

§ 2. This local law takes effect 1 year after it becomes law.
