Summary: Third-party food delivery services would be required to use tracking technology that could detect when food delivery workers who use a bicycle with electric assist or a limited use motorcycle engage in certain unsafe traffic behaviors while a food delivery worker is making a delivery or available to make a delivery. If a third-party food delivery service detects one of these unsafe traffic behaviors, it would be required to notify the worker in real time. If a food delivery worker receives three notifications of unsafe traffic behavior in a seven-day period from a third-party food delivery service, that third-party food delivery service would be prohibited from assigning the food delivery worker any deliveries until the food delivery worker completes a safety course.

A Local Law to amend the administrative code of the city of New York, in relation to requiring third-party delivery services to track and notify certain food delivery workers of certain unsafe traffic behaviors

 

Be it enacted by the Council as follows:

 

Section 1. Section 20-563 of the administrative code of the city of New York is amended by adding new definitions of “bicycle with electric assist,” “delivery device,” and “limited use motorcycle” in alphabetical order to read as follows:

Bicycle with electric assist. The term “bicycle with electric assist” has the same meaning as set forth in section 102-c of the vehicle and traffic law.

Delivery device. The term “delivery device” means a bicycle with electric assist or a limited use motorcycle.

Limited use motorcycle. The term “limited use motorcycle” has the same meaning as set forth in section 121-b of the vehicle and traffic law.

§ 2. Subchapter 36 of chapter 2 of title 20 of the administrative code of the city of New York is amended by adding a new section 20-563.14 to read as follows:

§ 20-563.14 Traffic safety tracking. a. A third-party food delivery service shall use tracking technology to monitor the movements of every food delivery worker who uses a delivery device to make deliveries for the third-party delivery service while the food delivery worker is available to make a delivery or is making a delivery for the third-party food delivery service.

b. The tracking technology required by subdivision a of this section shall be capable of detecting in real time when a food delivery worker using a delivery device:

1. Travels at a speed greater than the maximum speed limit established for the applicable street;

2. Travels over 4 miles per hour in the wrong direction on a roadway designated and signposted for one-way traffic; and

3. Travels over 4 miles per hour on a sidewalk.

c. A third-party food delivery service shall issue a real time notification to any food delivery worker who is required to be monitored pursuant to subdivision a of this section every time it detects the occurrence of any of the actions enumerated in paragraphs 1, 2, and 3 of subdivision b of this section.

d. A third-party food delivery service shall not offer or assign a delivery to a food delivery worker who it has notified pursuant to subdivision c of this section 3 times in any 7-day period until the food delivery worker completes a road safety course approved by the department of transportation that is distinct from the safety course required by paragraph 3 of subdivision e of section 10-157. No road safety course that a food delivery worker completed prior to the most recent notification that the third-party food delivery service issued to the food delivery worker shall satisfy such requirement.

e. A third-party food delivery service shall submit quarterly reports to the commissioner that include:

1. The number of notifications issued in the previous quarter pursuant to subdivision c of this section in total and disaggregated by:

(a) Notifications issued for each of the actions enumerated in paragraphs 1, 2, and 3 of subdivision b of this section;

(b) Borough; and

(c) Type of delivery device; and

2. The number of food delivery workers who received at least 3 notifications pursuant to subdivision c of this section in any 7-day period.

§ 3. This local law takes effect 180 days after it becomes law.
