Summary: This bill would require the Commissioner of Health and Mental Hygiene to create and maintain a publicly accessible database and map indicating certain buildings in which residents have been diagnosed with Legionnaires’ disease, buildings for which cooling tower testing results indicate levels of Legionella bacteria that are hazardous to human health, and relevant years. The database and map would also have to include this information for the previous 10 years.

A Local Law to amend the administrative code of the city of New York, in relation to requiring the commissioner of health and mental hygiene to maintain a public database of locations impacted by legionella

 

Be it enacted by the Council as follows:

 

Section 1. Chapter 1 of title 17 of the administrative code of the city of New York is amended by adding a new section 17-194.2 to read as follows:

§ 17-194.2 Public database of locations impacted by legionella. a. Definitions. As used in this section, the term “dwelling unit” has the same meaning as set forth in paragraph 13 of subdivision a of section 27-2004. 

b. No later than 30 days after the effective date of the local law that added this section, the commissioner shall establish and maintain on the department’s website a searchable, publicly accessible database, along with a corresponding interactive map, which records at minimum the following information, to the extent such information is known to or reasonably discoverable by the commissioner:

1. The street address of any residential building containing 4 or more dwelling units in which any occupant has been diagnosed with a laboratory-confirmed case of Legionnaires’ disease, as well as the year in which any such diagnosis occurred; and

2. The street address of any residential building for which the department has been notified of cooling tower test results that indicate levels of microbes that present a serious health threat, under subparagraph (b) of paragraph 2 of subdivision e of section 17-194.1 and any rules promulgated thereunder, as well as the year in which any such notification was received by the department.

c. The database and map required by subdivision b of this section shall also include the information required under such subdivision for the previous 10 years.

d. The commissioner shall update the database and map required by subdivision b of this section no later than 24 hours after receiving any information required to be recorded under paragraph 1 or 2 of such subdivision.

e. No information that is otherwise required to be reported pursuant to this section shall be reported in a manner that would violate any applicable provision of federal, state, or local law relating to the privacy of information.

§ 2. This local law takes effect immediately.
