A Local Law to amend the administrative code of the city of New York, in relation to quarterly reporting on confirmed firearm discharges
Be it enacted by the Council as follows:
Section 1. Section 14-150 of the administrative code of the city of New York is amended by adding a new subdivision g to read as follows:
g. Report on confirmed firearm discharges. 1. For purposes of this subdivision, the term “confirmed firearm discharge” means a discharge of a firearm, by any person other than a member of the department acting within the scope of their duties, that does not result in the shooting of any person and that the department corroborates with evidence recovered at the scene of such discharge. Such evidence may include, but need not be limited to:
(a) Ballistics;
(b) Property damage;
(c) Shell casings;
(d) Live ammunition;
(e) Recovery of the firearm discharged;
(f) Video; or
(g) Firsthand account by any witness.
2. No later than October 30, 2027, and within 30 days of the end of each subsequent quarter, the department shall post on its website a report on the number of confirmed firearm discharges during the previous quarter. Such report shall include:
(a) The total number of confirmed firearm discharges; and
(b) For each confirmed firearm discharge:
(1) The borough and precinct where such discharge occurred; and
(2) The approximate date, time, and location of such discharge.
3. Nothing in this subdivision shall be construed to impact the manner in which the department investigates any suspected discharge of a firearm, including, but not limited to, the evidence the department may use to corroborate such a discharge.
§ 2. This local law takes effect 1 year after it becomes law.
