A Local Law to amend the administrative code of the city of New York, in relation to department-disposed of and department-collected solid waste.

 

Be it enacted by the Council as follows:

 

Section 1.  The administrative code of the city of New York is amended by adding a new section 16-326 to read as follows:

§ 16-326 Temporary suspension of tonnage requirements for department-disposed of and department-collected solid waste.  a.  Notwithstanding any inconsistent provision of this chapter, the department shall not be required to reduce or recycle specific amounts of department-disposed of solid waste pursuant to section 16-304 of this chapter during the period July first, two thousand four to June thirtieth, two thousand six.

b.  Notwithstanding any inconsistent provision of this chapter, the department and its contractors shall not be required to recycle specific amounts of department-collected solid waste pursuant to subdivision a of section 16-305 of this chapter, provided that:  (1) for the period July first, two thousand four to June thirtieth, two thousand six the department and its contractors shall be required to recycle department-collected solid waste in an amount at least equal to the average tons per day of designated recyclable materials recycled in the three-month period of April, May and June of fiscal year 2004; and (2) unless other amounts are provided for by law enacted subsequent to the enactment of this section, beginning July first, two thousand six the department and its contractors shall be required to recycle department-collected solid waste in an amount at least equal to the average tons per day of designated recyclable materials recycled in fiscal year 2002.

§ 2. This local law shall take effect immediately and shall be deemed to have been in effect as of July 1, 2004.
