A Local Law to amend the Charter of the City of New York in relation to the acquisition of property.
Be it enacted by the Council as follows:
Section one. Section 381 of chapter 15 of the charter of the city of New York is hereby amended to read as follows:
§381. Authority to acquire real property. a. The city may acquire title in fee to real property or any interest therein whenever required for any public or municipal use or purpose or for the promotion of public utility, comfort, health, enjoyment or adornment. Such title or interest shall be acquired according to law by purchase, condemnation or otherwise.
b. Without regard to the manner in which the property is acquired, the city, and any agency or organization receiving funds from the city, shall not purchase such property for an amount greater than the fair market value for the zoned use of that property. Fair market value shall be determined by the commissioner of the department of citywide administrative services.
§2. This local law shall take effect on the first day of January following its approval by a majority of the voters casting ballots at the first general election which follows its approval by a majority vote of the city council.
