Introduction This bill would require certain businesses that supply their employees to clients for the performance of construction work or manual labor on the client’s construction site, in exchange for compensation, to be licensed. The term “construction” in this bill explicitly excludes handyman work. Applying for a license would require certain signed statements and select information on business operations, and each covered business would have to supply their workers with a series of notices: on their rights as workers covered by this bill; training and certifications the employees would need to perform their work duties; and information on the employees’ work assignments. The businesses’ clients would also receive some of these notices, and these clients could be subject to civil penalties if they use the services of an unlicensed business that is required to be licensed by this bill. Businesses that violate the bill’s subchapter would also be subject to penalties. Employees of the businesses aggrieved by a violation of the bill’s subchapter would be able to initiate a private right of action against their employers for violations of the bill, including for retaliation against employees for availing themselves of rights provided by this bill. Introduction This bill would amend the City’s data breach notification laws to align them with requirements in New York’s SHIELD Act. It would make certain definitions in City law more consistent with State law. City agencies that have suffered a security breach involving persons’ private identifying information would be required to promptly disclose it to the City’s Chief Privacy Officer, the Office of Cyber Command, and the Department of Information Technology and Telecommunications; formerly the NYPD received this type of disclosure. The obligation to make this type of disclosure – including to affected persons – would be expanded to situations in which the information was reasonably believed to have been accessed, disclosed or used by an unauthorized person. With some exceptions, the bill would mandate that if 5,000 or more New York residents must be notified at one time pursuant to Section 10-502 of the City’s Administrative Code, the notifying agency must also notify consumer reporting agencies as to the timing, content and distribution of the notices, and approximate number of affected individuals. Under the bill, an employee who is a parent or legal guardian of a child would be entitled to four hours of COVID-19 child vaccination time per vaccine injection for each child. The parent would be permitted to be absent to accompany their child to receive the vaccine, or care for the child due to side effects from the vaccine. COVID-19 child vaccination time would be paid at the employee’s regular rate of pay and would be in addition to the employee’s accrual or use of existing safe/sick time. It would be required to be paid by the next regular pay date. An employer could require that within seven days an employee provide documentation that their child was vaccinated. An employer could not require the employee to work additional hours to make up for the original hours the employee was unavailable, or find a replacement employee to cover the their hours, because the employee used COVID-19 child vaccination time. The bill’s requirements could not be waived, notwithstanding certain collective bargaining agreements. The bill would provide for relief and penalties for a failure to provide COVID-19 child vaccination time. It contains a 60-day phase-in period during which the Department of Consumer and Worker Protection would give written notice and a cure period before enforcing against employers who do not provide the new COVID-19 vaccination leave. Introduction This bill would offer expenditure limit relief to candidates participating in the City’s campaign finance program if they face high-spending independent spenders. Under the bill, when independent expenditures equal 50 percent of the expenditure limit in a particular election, the expenditure limit for all candidates in that election would increase by 50 percent. When independent expenditures equal 300 percent of the expenditure limit in a particular election, the expenditure limit for all candidates in that election would be lifted completely. In addition, it would remove a reference to “agency fees” which are no longer required to be paid by non-members. It would also allow non-members, in certain circumstances and with the permission of the union, to proceed through the grievance process and arbitration without union representation, so long as the non-member assumes the cost for arbitration that would otherwise be paid by the union.
