Brewer | | | Lease agreements concerning storefront premises. | Introduction | This bill would establish protections for tenants of storefront premises through a “Storefront Business Bill of Rights.” For any tenancy of more than one year, the bill would require a written lease for storefront premises. In addition, the bill provides for lease renewal procedures and the option to extend the lease in certain cases for up to one year with not more than a ten percent rent increase. The bill would further require an owner to provide a tenant with relevant information about the storefront premises to be leased. The bill would permit a court to impose civil penalties and award damages, equitable relief, attorneys’ fees and court costs for failure to comply with these requirements. The Commissioner of Small Business Services would oversee administration of the bill’s lease requirements and would also be required to make available online model commercial leases for storefront premises, as well as translations of such leases in other languages. | | |

SBS would be required to engage in public outreach to assess level of interest among content creators and small businesses; publicize the program on SBS’s website and through further outreach; create applications for both small businesses and content creators; and match content creators with small businesses seeking marketing and social media support. At the end of the pilot program, SBS would be required to submit a report to the mayor and the speaker of the Council on the results of the program. | | |

The commission would add three new members: two appointed by the Speaker and one by the Public Advocate. The bill would require a two-thirds supermajority vote for any amendments or repeals of existing IBZ boundaries. The commission would be required to notify the City Council of any approved boundary changes within five business days. Commission members would be prohibited from having financial interests in real estate development entities or land use consulting firms, and registered lobbyists would be barred from serving on the commission. | | |

| * | Virginia Maloney | | | Establishing a legacy business registry and preservation fund. | Introduction | This bill would require the Commissioner of Small Business Services (“SBS”) to establish a Legacy Business Registry to recognize businesses that have operated in New York City for a minimum of 20 years and that have significantly contributed to the history, identity or character of a neighborhood or community in the City. In order to be part of the Legacy Business Registry, a business would be required to be nominated by the Mayor, the Public Advocate, a Borough President, or a Member of the City Council. In addition, the Commissioner of SBS would consult with the relevant Community Board and the Landmarks Preservation Commission regarding whether a business meets the requirements to be designated as a Legacy Business. The bill would also require the Commissioner of SBS to carry out activities to recognize the contributions of Legacy Businesses to their communities, and to establish a Legacy Business Preservation Fund to award grants to Legacy Businesses and property owners who offer a 10-year lease to a Legacy Business, in cases in which a Legacy Business faces a significant risk of displacement. | | |
