Res. No. 1305

Resolution calling on the New York State Legislature to pass  A. 7213-A/S. 5375-A, an act to amend the Administrative Code of the City of New York, in relation to allowing members of the Police Department to remain in service until age 65.

By Council Members Gonzalez, Fidler and Nelson

Whereas, The New York State Legislature is considering A. 7213-A/S. 5375-A, an act to amend the Administrative Code of the City of New York, in relation to allowing members of the New York City Police Department (NYPD) to remain in service until age 65; and

Whereas, The Administrative Code currently provides that no member of the police force in  the NYPD,  with the exception of surgeons, a roentgenologist and a veterinarian, may continue  to  serve  in such force once they attain the age of 63; and

Whereas, The Administrative Code also provides that any such member who is  not eligible for retirement at age 63 may continue to serve as a member only until such  time  as he  or  she  becomes  eligible  for   pension  service retirement; and

Whereas, The Administrative Code further provides that any member who has not completed  35  years  of creditable  City  service prior to attaining the age of 63 years may continue  to  serve  as a member until he or she shall have completed such thirty-five years of creditable City service; and

Whereas, Mandatory retirement is required of NYPD officers due to the physical and hazardous nature of the job; and

Whereas, Members of the New York City Fire Department (FDNY) perform job duties that are also physical and hazardous in nature and have a mandatory retirement age of 65; and

Whereas, A report issued by the Independent Budget Office in 2002 indicated that the rising number of NYPD retirements were due to the high levels of overtime worked by police officers in response to the September 11, 2001 attacks; and

Whereas, The continued high levels of retirement within the NYPD minimizes the number of veteran officers, who provide expertise, invaluable leadership, and stability to this workforce, which faces obstacles with respect to recruitment and retention; and

Whereas, A. 7213-A/S. 5375-A would increase the mandatory retirement age for members of the NYPD from 63 to 65 and provide parity between such members and members of FDNY; and

Whereas, Efforts to retain veteran officers without compromising job safety and performance must be given serious consideration; now, therefore, be it

Resolved, That the Council of the City of New York calls on the New York State Legislature to pass  A. 7213-A/S. 5375-A, an act to amend the Administrative Code of the City of New York, in relation to allowing members of the Police Department to remain in service until age 65.
