A Local Law to amend the administrative code of the city of New York, in relation to requiring that the affidavits required for the filing of a real property transfer tax return on the sale of one- or two- family dwellings as well as cooperative and condominium apartments indicate that the premises sold is equipped with an operational carbon monoxide detecting device as well as a smoke detecting device.

 

Be it enacted by the Council as follows:

 

                     Section 1.  Subdivision g of section 11-2105 of the administrative code of the city of New York is re-lettered as subdivision h and as re-lettered is amended to read as follows:

h.                     Returns with respect to the conveyance of a one- or two-family dwelling, an

individual residential condominium unit and the shares of stock allocable to an individual cooperative apartment will not be accepted for filing unless accompanied by [an affidavit] affidavits signed by the grantor and grantee and by any person who has appraised the dwelling, at the time of the inspection of the condominium unit or cooperative apartment to establish its value, indicating that the premises is equipped with [an] approved and operational smoke and carbon monoxide detecting [device] devices as provided in [article] articles six and seven of subchapter seventeen of chapter one of title twenty-seven of this code.

§ 2.  This local law shall take effect immediately upon enactment.
