A Local Law to amend the administrative code of the city of New York, in relation to emergency evacuation and community notification plans for certain buildings that have received a variance to store diesel fuel or store more than a threshold amount of diesel fuel.

 

Be it enacted by the Council as follows:

Section 1. Chapter four of title 27 of the administrative code of the city of New York is amended by adding a new section 27-4267.6 to read as follows:

§27-4267.6 Evacuation of buildings storing diesel fuel.  The commissioner shall promulgate rules establishing standards, procedures and requirements for the orderly evacuation of building occupants in the event of an emergency from any building more than 60 feet in height that has received a variance for the storage of diesel fuel or that has a maximum diesel fuel storage capacity equal to or in excess of one-half of the maximum permitted by section 27-829 (b)(1) of this code. Such rules shall require any owner of such a building to develop a written emergency action plan, with provisions for identifying qualified personnel, conducting drills, distributing instructions or informative materials to occupants, and/or such other standards, procedures or requirements that the fire commissioner determines will serve to ensure orderly evacuation of the building. Such rules shall also establish requirements for the occupants of such buildings with respect to evacuation and the planning therefore and for the development of community notification plans whereby affected and potentially affected individuals, buildings and communities can be informed, in a timely manner, about the emergency and given instructions on what to do and where to go. Such rules shall distinguish the method of the notification based upon the type of emergency, whether the notification is being given to safeguard health or property, and whether that notification is required to be given to the building occupants, the occupants of adjacent buildings, the surrounding community within the local fire department first due response area, neighboring communities or the city at large.  These requirements shall be in addition to the requirements of sections 27-4267, 27-4267.3, 27-4267.4, 27-4267.5 of this code and any other law, rule or regulation enforced by the department.

§2. This local law shall take effect ninety days after its enactment into law.
