A Local Law to amend the administrative code of the city of New York, in relation to requiring owners to notify tenants of unsafe conditions of exterior walls of buildings.

 

Be it enacted by the Council as follows:

 

Section 1.  Subdivision b of section 27-129 of the administrative code of the city of New York is amended to read as follows:

§27-129  (b) Notification requirements.  Whenever an architect or engineer learns through a critical examination of a building’s exterior walls and appurtenances thereof of an unsafe condition prior to the filing of a report with the department of buildings pursuant to subdivision (c) of this section, he or she shall notify the owner and the department of buildings immediately in writing of such condition.  Upon such notification, the owner shall immediately notify the occupants of the building of any unsafe condition by affixing a notice describing each unsafe condition in a conspicuous location in the lobby area of the building which notice shall remain until each unsafe condition is corrected.  Notice to occupants shall also be given in at least one additional manner as shall be established by the commissioner by rule.

§2.  This local law shall take effect ninety days from its enactment, provided however, that the commissioner of buildings shall promulgate any rules and perform all other actions necessary for the implementation of this local law prior to such effective date.
