A Local Law to amend the administrative code of the city of New York, in relation to requiring that all diesel fuel storage tanks located inside of buildings above the lowest floor and on rooftops and building setbacks be completely encased to provide added safety.

 

Be it enacted by the Council as follows:

 

                     Section 1.  Paragraph 1 of subdivision b of section 27-829 of the administrative code of the city of New York is amended to read as follows:

(1)  Fuel oil storage tanks having a capacity of two hundred seventy-five gallons or less may be installed inside of buildings above the lowest story [when provided with a four inch thick concrete or masonry curb, or with a metal pan of gauge equal to the gauge of the tank, completely surrounding the tank and of sufficient height to contain two times the capacity of the tank.], provided that all portions of such tanks are completely enclosed with reinforced concrete at least six inches thick having at least a two hour fire resistance rating.  There shall be no openings in the enclosure except those necessary for access to, inspection of, and the filling, emptying and venting of the tank.  The number of such oil storage tanks shall be limited to one per story.  Any such storage tank that has been installed prior to the effective date of this paragraph shall be brought into compliance with this paragraph within ninety days of the  effective date of the local law that amended this paragraph.

§2.  Subdivision b of section 27-829 of the administrative code of the city of New York is amended by adding a new paragraph 4 to read as follows:

(4) A storage tank located on the rooftop or setback of a building shall be subject to the same provisions of this code as a storage tank located on the inside of a building above the lowest floor.  Any such storage tank that has been installed prior to the effective date of the local law that added this paragraph shall be brought into compliance with this paragraph within ninety days of such effective date.

§3.  This local law shall take effect ninety days after its enactment.
