A Local Law to amend the administrative code of the city of New York, in relation to requiring impact noise reduction for trash receptacles collected by mechanical means.

 

Be it enacted by the Council as follows:

Section 1. Section 24-225 of the administrative code of the city of New York is amended by adding a new subdivision c to read as follows:

c.(i)Any solid waste receptacle being lifted by mechanical means to be emptied into a truck, and then placed back on the ground, must have cushioning or some other device that reduces noise caused by the receptacle coming into contact with the truck or the ground.  The department shall establish acceptable decibel limits for impact noise caused by said receptacles coming in contact with a truck or placing these receptacles back on the ground.

 (ii)  Any business licensed pursuant to subdivision a of section 16-505 of this code found to be in violation of  subdivision c (i) of this section more than three times in any twelve month period, in addition to any other penalties imposed pursuant to this chapter, shall have their license granted pursuant to section 16-505 suspended for a period of  ten days.

                                          §2. This law shall take effect on January 1, 2007.
