Resolution calling upon the New York State legislature to amend the Vehicle and Traffic Law, in relation to the placement of automobile license plates within frames.

 

By Council Members Gentile, Recchia Jr. and Seabrook

 

Whereas, Section 402 of the Vehicle and Traffic Law currently prohibits the use of coverings made of glass or any plastic material on license plates. Such plates are also prohibited from being knowingly covered or coated with any “artificial or synthetic material or substance that conceals or obscures such number plates or that distorts a recorded or photographic image of such number plates”; and

Whereas, An individual receiving a summons from the New York Police Department for violating this law is subject to a fine of not less than twenty-five dollars and not more than two hundred dollars; and

Whereas, A frame around a New York State automobile license plate that does not render the numbers or letters on said plate unreadable does not interfere with the ability of law enforcement personnel to perform their duties or in any way hinder the identification of the vehicle; and

Whereas, The Vehicle and Traffic Law should be amended to clearly permit an automobile license plate to be placed within a frame, so long as such frame does not obscure the numbers or letters of the license plate or render the information unreadable and any one of the two state logos remains in full view; now, therefore, be it

Resolved, That the Council of the City of New York calls upon the New York State legislature to amend the Vehicle and Traffic Law in relation to the placement of automobile license plates within frames.
