RESOLUTION NO. 498
Resolution disapproving the petition for a revocable consent for an unenclosed sidewalk café located at 324 Bowery, Manhattan (20045558 TCM; L.U. No. 199).

WHEREAS, the Department of Consumer Affairs filed with the Council on June 14, 2004 its approval of the petition of G.D.P. Enterprises, Inc., d/b/a Agozar (the “Applicant”), for a revocable consent to establish, maintain and operate an unenclosed sidewalk café located at 324 Bowery, Community District 2, Borough of Manhattan (the "Petition"), pursuant to Section 20-226 of the New York City Administrative Code (the "Administrative Code");
WHEREAS, the Petition is subject to review by the Council pursuant to Section 20-226(g) of the Administrative Code;
WHEREAS, upon due notice, the Council held a public hearing on the Petition on July 19, 2004; and
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Petition;
RESOLVED:
Pursuant to Section 20-226 of the Administrative Code, the Council disapproves the Petition.
