RESOLUTION NO. 1995
Resolution approving the decision of the City Planning Commission on ULURP No. M 090312 ZMK, for the modification of a Restrictive Declaration, which was approved as part of a Zoning Map Amendment (CP 21749), to eliminate the restriction that the property be limited to hospital and hospital-related uses, including nursing home facilities and the restriction that the parking be subject to the requirements applicable in an R4 District, on property located at 783 Eldert Lane (Block 4469, Lots 1, 6, 10, 16 and 54), in an R6 District (L.U. No. 1103).

WHEREAS, the City Planning Commission filed with the Council on April 27, 2009 its decision dated April 22, 2009 (the "Decision"), on the application submitted by Hudson Eldert, LLC, and Skyview Realty Association, Ltd., for the modification of the Restrictive Declaration dated December 20, 1971 and originally approved as part of an application for the modification of a Restrictive Declaration, which was approved as part of an application for a Zoning Map Amendment (CP 21749), to permit residential development on property generally bounded by Eldert Lane, Dumont Avenue, Drew Street and Linden Boulevard (Block 4469, Lots 1, 6, 10, 16 and 54), in an R6 District (ULURP No. M 090312 ZMK), Community District 5, Borough of Brooklyn (the "Application");
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter;
WHEREAS, the subject application is a request by Hudson Eldert, LLC, and Skyview Realty Association, Ltd., to modify the Restrictive Declaration as it relates to the subject property so as to facilitate Hudson’s development of an apartment building which will provide affordable rental housing to low income residents, to facilitate Skyview’s construction of senior housing and/or senior assisted living housing and/or replace the existing nursing home facility with a new nursing home facility, and to ensure compliance with project components related to the environment;;
WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on May 12, 2009;
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and
WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration issued on April 22, 2009 (CEQR No. 09DCP072K);
RESOLVED:
The Council finds that the action described herein will have no significant effect on the environment.
Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, the Council approves the decision.
