Resolution approving the petition for a revocable consent for an unenclosed sidewalk café located at 182 Eighth Avenue, Borough of Manhattan (20085462 TCM; L.U. No. 955).

WHEREAS, the Department of Consumer Affairs filed with the Council on December 12, 2008 its approval dated December 12, 2008 of the petition of Buckwheat and Alfalfa, Inc., d/b/a Rocking Horse Mexican Café, for a revocable consent to continue to maintain and operate an unenclosed sidewalk café located at 182 Eighth Avenue, Community District 4, Borough of Manhattan (the "Petition"), pursuant to Section 20-226 of the New York City Administrative Code (the "Administrative Code");
WHEREAS, the Petition is subject to review by the Council pursuant to Section 20-226(g) of the Administrative Code;
WHEREAS, upon due notice, the Council held a public hearing on the Petition on January 26, 2009; and
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Petition;
RESOLVED:
Pursuant to Section 20-226 of the Administrative Code, the Council approves the Petition.
