THE COUNCIL OF THE CITY OF NEW YORK

RESOLUTION NO. 1449

 

Resolution approving the Maritime Lease agreement of 30th Street Pier located at the South Brooklyn Marine Terminal (Block 662, portions of Lot 1 in portion), Borough of Brooklyn (20085592 PNK; L.U. No. 772).

 

By Council Members Katz, Comrie and Lappin

 

                           WHEREAS, the Department of Small Business Services filed with the Council on May 7, 2008, pursuant to Sections 1301(2)(f) and (g) of the New York City Charter, a lease agreement between the City of New York Department of Small Business Services and the Sims Municipal Recycling of New York, LLC of property generally located at South Brooklyn Marine Terminal consisting of  519,050 square feet of solid fill pier (including riprap) constituting the 30th Street Pier, plus approximately 415,000 square feet of water/land under water (partly exclusive) plus a non-exclusive access easement, all constituting part of Lot 1, within Block 662, within the South Brooklyn Marine Terminal, upon terms and conditions set forth in the Lease Agreement, a copy of which is attached hereto (the "Lease"), Community District 7, Borough of Brooklyn;

 

                           WHEREAS, the Lease Agreement is subject to review and action by the Council pursuant to Sections 1301(2)(f) and (g) of the New York City Charter;

 

                           WHEREAS, upon due notice, the Council held a public hearing on the Lease on May 20, 2008;

 

                     WHEREAS, the Council has considered the relevant environmental review (CEQR No. 08-DOS-001K) and the fact that a Negative Declaration was issued on March 26, 2008;

 

                           WHEREAS, the Council has considered the land use and financial implications and other policy issues relating to the Lease;

 

RESOLVED:

 

                     The Council finds that the action described herein shall have no significant effect on the environment.

 

                           Pursuant to Sections 1301(2)(f) and (g) of the New York City Charter, the Council approves the Lease and upon the terms and conditions set forth in the Lease Agreement by the Department of Small Business Services, a copy of which is attached hereto.
