THE COUNCIL OF THE CITY OF NEW YORK
RESOLUTION NO. 1433
Resolution approving the decision of the City Planning Commission on ULURP No. C 070577 ZSM (L.U. No. 746), for the grant of a special permit pursuant to Sections 13-562 and 74-52 of the Zoning Resolution to allow an attended public parking garage with a maximum capacity of 76 spaces on portions of the ground floor, cellar and subcellar of a proposed mixed use development on property located at 31-37 West 56th Street (Block 1272/Lots 14, 15, 16, 17 and 18), in a C5-P District, within the Special Midtown District, Borough of Manhattan.

WHEREAS, the City Planning Commission filed with the Council on April 1, 2008 its decision dated March 26, 2008 (the "Decision") on the application submitted by MCP SO Strategic 56, LP, pursuant to Sections 197-c and 201 of the New York City Charter, for the grant of a special permit pursuant to Sections 13-562 and 74-52 of the Zoning Resolution of the City of New York to allow an attended public parking garage with a maximum capacity of 76 spaces on portions of the ground floor, cellar and sub-cellar of a proposed mixed use building on property located at 31-37 West 56th Street (Block 1272/Lots 14, 15, 16, 17 and 18), in a C5-P District, within the Special Midtown District (ULURP No. C 070577 ZSM), Community District 5, Borough of Manhattan (the "Application");
WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter;
WHEREAS, the City Planning Commission has made the findings required pursuant to Section 74-52 of the Zoning Resolution;
WHEREAS, upon due notice, the Council held a public hearing on May 6, 2008 on the Decision and Application;
WHEREAS, by letter dated May 6, 2008, the applicant has agreed to reserve 30 spaces for monthly parking;
WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on December 17, 2007 (CEQR No. 07DCP079M);
WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application;
RESOLVED:
The Council finds that the action described herein will have no significant effect on the environment.
Pursuant to Sections 197-d and 200 of the New York City Charter and on the basis of the Decision and Application, the Council approves the Decision.
