THE COUNCIL OF THE CITY OF NEW YORK

RESOLUTION NO. 1320

 

Resolution approving the decision of the City Planning Commission on an application submitted by the Department of Housing Preservation and Development, ULURP No. C 080067 HAM, approving the disposition of property located at 103-07, 137-43, and 151-59 West 108th Street (Block 1863, Lots 26, 13, and 5), (L.U. No.  669; C 080067 HAM).

WHEREAS, the City Planning Commission filed with the Council on January 28, 2008 its decision dated January 28, 2008 (the "Decision"), on the application submitted by the Department of Housing Preservation and Development pursuant to Section 197-c of the New York City Charter and Article 16 of the General Municipal Law of New York State regarding:

 

a)                     the designation of property located at 103-07, 137-43, and 151-59 West 108th Street (Block 1863, Lots 26, 13, and 5), Sites 3, 3B, and 3D within the Cathedral Parkway Urban Renewal Area), as an Urban Development Action Area (the "Area");

 

b)                     an Urban Development Action Area Project for such area (the "Project"); and

 

pursuant to Section 197-c of the New York City Charter for the disposition of such property to a developer selected by the Department of Housing Preservation and Development to facilitate the continued use of  these properties as public parking garages (the "Disposition"), Community District 7, Borough of Manhattan (ULURP No. C 080067 HAM) (the "Application");

 

                     WHEREAS, the Application is related to Application Number C 080066 HUM (L.U. No. 668), the fifth amendment to the Cathedral Parkway Urban Renewal Plan;

 

WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter;

 

Whereas, by submission dated March 11, 2008, the Department of Housing Preservation and Development withdrew the application regarding:

 

a)                     the designation of property located at 103-07, 137-43, and 151-59 West 108th Street (Block 1863, Lots 26, 13, and 5), Sites 3, 3B, and 3D within the Cathedral Parkway Urban Renewal Area), as an Urban Development Action Area (the "Area");

b)                     an Urban Development Action Area Project for such area (the "Project"); and

 

WHEREAS, the Application and Decision are subject to review and action by the Council pursuant to Article 16 of the General Municipal Law of New York State;

 

                       WHEREAS, the New York City Department of Housing Preservation and Development ("HPD") submitted to the Council its recommendations regarding the Application on January 30, 2008;

 

                       WHEREAS, upon due notice, the Council held a public hearing on the Application and Decision on March 4, 2008;

 

                       WHEREAS, the Council has considered the relevant environmental review (CEQR No. 06HPD024M) and the fact that a Negative Declaration was issued on July 14, 2006;

 

                       WHEREAS, the Council has considered the land use and financial implications and other policy issues relating to the Application;

 

RESOLVED:

 

The Council finds that the actions described herein will have no significant effect on the environment;

 

 Pursuant to Section 197-d, the Council approves the decision of the City Planning Commission (C 080067 HAM), with respect to the disposition of property located at 103-07, 137-43, and 151-59 West 108th Street (Block 1863, Lots 26, 13, and 5).
