THE COUNCIL OF THE CITY OF NEW YORK

RESOLUTION NO. 1138

Resolution approving the decision of the City Planning Commission on ULURP No. C 070521 ZMQ, a Zoning Map change (L.U. No. 599).

WHEREAS, the City Planning Commission filed with the Council on October 5, 2007 its decision dated October 3, 2007 (the "Decision"), on the application submitted by the Department of City Planning, pursuant to Sections 197-c and 201 of the New York City Charter, for an amendment to the Zoning Map (ULURP No. C 070521 ZMQ) (the "Application");

WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(1) of the City Charter;

WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on October 23, 2007;

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and

                      WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on June 18, 2007 (CEQR No. 07DCP091Q);

RESOLVED:

The Council finds that the action described herein will have no significant effect on the environment.

Pursuant to Sections 197-d and 200 of the City Charter and on the basis of the Decision and Application, the Council approves the Decision.

                     The Zoning Resolution of the City of New York, effective as of December 15, 1961, and as subsequently amended, is further amended by changing the Zoning Map, Section No. 14b:

1.                                          eliminating from within an existing R3-2 District a C1-2 District bounded by a line 150                      feet northerly of Metropolitan Avenue, 70^th Avenue, Olcott Street, 71^st Avenue, a line                      150 feet northerly of Metropolitan Avenue, Nansen Street, 72^nd Avenue, Metropolitan                      Avenue, 71^st Avenue, a line 150 feet southerly of Metropolitan Avenue, a line 100 feet                      westerly of 69^th Avenue, Metropolitan Avenue, and Selfridge Street;

2.                                          eliminating from within an existing R3-2 District a C2-2 District bounded by a line 150                      feet northerly of Metropolitan Avenue, 74^th Avenue, Metropolitan Avenue, 72^nd Road, a                      line 150 feet southerly of Metropolitan Avenue, 71^st Avenue, Metropolitan Avenue, and                      72^nd Avenue;

3.                     changing from an R3-2 District to an R3-1 District property bounded by Kessel Street, Union Turnpike, 75^th Road, a line 100 feet northerly of Metropolitan Avenue, a line midway between 75^th Avenue and 75^th Road, a line 75 feet southerly of Kessel Street, and 75^th Road;

4.                     changing from an R3-2 District to an R3A District property bounded by:

a.                                          a line midway between Kessel Street and Loubet Street, 71^st Avenue, a line                      midway between Juno Street and Kessel Street, a line 100 feet northwesterly of                      Ascan Avenue, Manse Street, 72^nd Road, a line 100 feet northerly of                      Metropolitan Avenue, 71^st Avenue, Olcott Street, a line 100 feet northerly of                      Metropolitan Avenue, and 69^th Avenue; and

b.                     a line 100 feet southerly of Metropolitan Avenue, 74^th Avenue, Union Turnpike, 71^st Avenue, a line 175 feet northerly of Sybilla Street, a line midway between                      70^th Drive and 70^th Road, a line 235 feet northerly of Sybilla Street, a line midway between 70^th Road and 70^th Avenue, Sybilla Street and its westerly centerline prolongation, a southwesterly street line of Sybilla Street, and its northwesterly prolongation, and a line 100 feet westerly of 69^th Avenue;

5.                     changing from an R3-2 District to an R3X District property bounded by Kessel Street, 75^th Road, a line 75 feet southerly of Kessel Street, a line midway between 75^th Avenue and 75^th Road, a line 100 feet northerly of Metropolitan Avenue, a line 100 feet westerly of  74^th Avenue, a line midway between 74^th Avenue and Ascan Avenue, a line 75 feet southerly of Kessel Street, and Ascan Avenue;

6.                     establishing within an existing R3-2 District a C1-3 District bounded by a line 100 feet northerly of Metropolitan Avenue, Olcott Street, 71^st Avenue, a line 100 feet northerly of Metropolitan Avenue, 72^nd Avenue, Metropolitan Avenue, 71^st Avenue, a line 100 feet southerly of Metropolitan Avenue, a line 100 feet westerly of 69^th Avenue, Metropolitan Avenue, and Selfridge Street; and

7.                     establishing within an existing R3-2 District a C2-3 District bounded by a line 100 feet northerly of Metropolitan Avenue, 74^th Avenue, Metropolitan Avenue, 72^nd Road, a line 100 feet southerly of Metropolitan Avenue, 71^st Avenue, Metropolitan Avenue, and 72^nd Avenue;

as shown on a diagram (for illustrative purposes only) dated June 18, 2007, Community District 6, Borough of Queens.
