RESOLUTION NO. 1049

Resolution approving the petition for a revocable consent for an unenclosed sidewalk café located at 1641 Second Avenue, Borough of Manhattan (20075497 TCM; L.U. No. 540).

WHEREAS, the Department of Consumer Affairs filed with the Council on August 9, 2007 its approval of the petition dated July 24, 2007 submitted by KMG Group, LLC, d/b/a Molly Pitcher’s Ale House (the “Applicant”), for a revocable consent to establish, maintain and operate an unenclosed sidewalk café located at 1641 Second Avenue, Community District 8, Borough of Manhattan,  (the "Petition"), pursuant to Section 20-226 of the New York City Administrative Code (the "Administrative Code");

WHEREAS, the Petition is subject to review by the Council pursuant to Section 20-226(g) of the Administrative Code;

WHEREAS, upon due notice, the Council held a public hearing on the Petition on September 5, 2007; and

WHEREAS, the Council has considered the land use implications and other policy issues relating to the Petition;

RESOLVED:

Pursuant to Section 20-226 of the Administrative Code, the Council approves the Petition.
