THE COUNCIL OF THE CITY OF NEW YORK

RESOLUTION NO. 1028

 

Resolution approving the decision of the City Planning Commission on an application submitted by the Department of Housing Preservation and Development (“HPD”), No. N 070467 HAM, approving the designation of property located at 217 West 147th Street (Block 2033, Lot 12) Site 27 within the Bradhurst Urban Renewal Area, Manhattan, as an Urban Development Action Area (the “Area”), and approving the project for the area as an Urban Development Action Area Project (L.U. No. 528; N 070467 HAM).

                     WHEREAS, the City Planning Commission filed with the Council on July 27, 2007 its decision dated July 25, 2007 (the "Decision"), on the application submitted by the Department of Housing Preservation and Development pursuant to Article 16 of the General Municipal Law of New York State regarding:

 

                     a)                     the designation of property located at 217 West 147th Street (Block 2033, Lot 12) Site 27 within the Bradhurst Urban Renewal Area, as an Urban Development Action Area (the "Area"); and

 

                     b)                     an Urban Development Action Area Project for such area (the "Project");

 

to facilitate the development a six-story mixed-use building, tentatively known as P.S. 90, with approximately 75 residential units and community facility space in Community District 10, Borough of Manhattan (Number N 070467 HAM) (the "Application");

 

                     WHEREAS, the Application is related to ULURP Nos. C 960467 HUM (L.U. No. 1220, Res. No. 2371 of 1997); C 960469 HDM (L.U. No. 1222, Res. No. 2377 of 1997); and C 040269 HUM (L.U. No. 104, Res. No. 487 of 2004);

 

                     WHEREAS, the Application and Decision are subject to review and action by the Council pursuant to Article 16 of the General Municipal Law of New York State;

 

                     WHEREAS, on June 29, 2007, the Department of Housing Preservation and Development submitted a letter requesting findings pursuant to Article 16;

 

                     WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on May 17, 2007 (CEQR No. 06HPD004M);

 

                     WHEREAS, upon due notice, the Council held a public hearing on the Application and Decision on August 20, 2007;

 

                     WHEREAS, the Council has considered the land use and financial implications and other policy issues relating to the Application;

 

RESOLVED:

 

                     The Council finds that the actions described herein will have no significant effect on the environment;

 

                       Pursuant to Article 16 of the General Municipal Law, the Council approves the decision of the City Planning Commission (N 070467 HAM).

 

                       The Council finds that the present status of the Disposition Area tends to impair or arrest the sound growth and development of the City of New York and that a designation of the Project as an urban development action area project is consistent with the policy and purposes stated in Section 691 of the General Municipal Law.

 

                       The Council approves the designation of the Disposition Area as an urban development action area pursuant to Section 693 of the General Municipal Law.

 

                       The Council approves the Project as an urban development action area project pursuant to Section 694 of the General Municipal Law.
