THE COUNCIL OF THE CITY OF NEW YORK

RESOLUTION NO. 972

 

Resolution approving the decision of the City Planning Commission on ULURP No. C 070077 MMQ, an amendment to the City Map (L.U. No. 482).

 

By Council Members Katz and Garodnick

 

                           WHEREAS, the City Planning Commission filed with the Council on June 27, 2007 its decision dated June 20, 2007 (the "Decision"), on the application submitted by the New York City Department of Transportation, the Economic Development Corporation and the Department of Parks and Recreation, pursuant to Sections 197-c and 199 of the New York City Charter and Section 5-430 et seq. of the New York City Administrative Code, for a change in the City Map involving:

 

                     the narrowing and realignment of Atlantic Avenue between 94th and 95th avenues;

 

                     the establishment of a park;

 

                     the narrowing of a portion of 94th Avenue between Atlantic Avenue and 138th Place;

 

                     the adjustment of grades necessitated thereby; and

 

                     any acquisition or disposition of real properties related thereto,

 

in accordance with Map No. 4992 dated December 11, 2006 and signed by the Borough President Community District 12, Borough of Queens (ULURP No. C 070077 MMQ) (the "Application");

 

                           WHEREAS, the Decision is subject to review and action by the Council pursuant to Section 197-d(b)(3) of the City Charter;

 

                           WHEREAS, upon due notice, the Council held a public hearing on the Decision and Application on July 23, 2007;

 

                           WHEREAS, the Council has considered the land use implications and other policy issues relating to the Decision and Application; and

 

WHEREAS, the Council has considered the relevant environmental issues and the Negative Declaration, issued on January 12, 2007 (CEQR No. 07DOT001Q);

 

RESOLVED:

 

                           The Council finds the action described herein will have no significant effect on the environment.

 

                           Pursuant to Sections 197-d and 199 of the New York City Charter, the Council approves the Decision.
